Open Burning Requirements
Before conducting any open burn, you are required to notify the County Dispatch Center each day you plan to burn. Please call (479) 273‑5530, toll‑free at (866) 207‑5140, or you can also fill out a form online at : https://bentoncountyar.gov/fire-marshal/submit-controlled-burn/
Permitted Burning
- Yard waste (leaves, grass, branches)
- Agricultural clearing operations
You must remain on-site and monitor the fire continuously until it is fully extinguished. If the fire becomes unsafe or unmanageable, call 911 immediately.
During burning, means of extinguishing the fire, such as a portable fire extinguisher (4-A rated min.), a connected water hose or other water source, a shovel & dirt, or sand.
Prohibited Materials
The following materials cannot be burned under any circumstances:
- Household trash
- Tires
- Chemicals
- Construction or demolition waste
- Salvage materials
- Treated or untreated lumber
Open burning of any material not specifically allowed is a violation of state law.
Minimum required distances from structures
Open Burning = 50'
Burn pile that is no more than 3' in diameter and 2' high = 25'
Approved container = 15'
